Court Adjourns El-Rufai Bail Hearing Following ICPC Opposition

KADUNA, Nigeria — A High Court in Kaduna has adjourned the hearing for a fresh bail application filed by the former governor of Kaduna State, Nasir El-Rufai, to 13 May 2026.

The Independent Corrupt Practices and Other Related Offences Commission (ICPC) has formally opposed the application, filing a counteraffidavit to keep the former governor in custody.


Procedural Delays

During Tuesday’s proceedings, defense counsel Ubong Akpang urged the court to consider the application, citing concerns over his client’s liberty. However, the prosecution argued they had only just received the defendant’s latest supporting affidavit and required time to review the new documents.

Justice D.H. Khobo subsequently moved the hearing to next week to allow the legal teams to study the fresh filings.

Previous Bail Refusal

This latest legal move follows an earlier decision by the court to deny Mr. El-Rufai bail. In that ruling, Justice Khobo highlighted several concerns raised by the ICPC, including:

  • Flight Risk: Concerns that the defendant’s influence and resources could facilitate an escape.
  • Obstruction Allegations: Claims of an alleged attempt to obstruct arrest at Abuja’s international airport.
  • Evidence Interference: Fears that the former governor might interfere with witnesses or ongoing investigations, particularly as other suspects remain at large.
  • Lack of Evidence: The court dismissed the defense’s prior health-related claims, citing insufficient evidence.

Ongoing Custody

The court had previously ruled that bail is a discretionary matter that must serve the interest of justice. Following the initial dismissal of his bail request, the court ordered an accelerated hearing.

For now, Mr. El-Rufai is to remain in ICPC custody pending the commencement of the trial. The commission has reaffirmed its commitment to the “diligent prosecution” of the corruption case and the upholding of due process.
