Federal High Court Restrains FRSC from Arresting Vehicles with Faded Number Plates

A Federal High Court in Lagos has restrained the Federal Road Safety Corps (FRSC) from arresting vehicles with faded number plates. The court also prohibited the FRSC from imposing fines or punishments on drivers with faded vehicle number plates.

Justice Aluko delivered the judgment in a suit filed by Chinwike Chamberlain Ezebube against the FRSC. The plaintiff had asked the court to determine whether the FRSC was responsible for the quality and durability of vehicle number plates, and whether it could penalize drivers for using faded plates.

The court ruled that while the FRSC cannot criminalize the use of faded vehicle number plates, drivers have a duty to approach the FRSC for a replacement upon payment of the requisite fees.

The judgment specifically granted three orders:

  • Restraining the FRSC: from declaring it an offense to drive with a faded vehicle number plate.
  • Prohibiting Fines and Punishments: from imposing any fine or punishment on drivers for using faded vehicle number plates.
  • Replacement of Faded Plates: directing drivers to approach the FRSC for replacement of faded plates upon payment of the requisite fees.
